Terms and Conditions

Last updated: June 19th 2025

Please read these Terms and Conditions ("Terms") carefully before using the website of Willow Cottage Bakery LLC ("we," "us," or "our"). These Terms apply to all users of our website and customers purchasing our goods.

1. Business Information Willow Cottage Bakery LLC is a New York–based cottage bakery offering artisanal cookies, cakes, and other baked goods. Our products are made in small batches using premium ingredients and are sold directly to customers through local markets, events, dessert catering, and online ordering. We operate in compliance with New York State laws and are located in Irvington, NY 10533. You may contact us at willowcottagebakery@gmail.com.

2. Acceptance of Terms By accessing or using our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use our website or place an order.

Users agree not to use this site for any unlawful purpose or in any way that may impair its functionality or integrity.

3. Products and Services We sell physical baked goods, and occasionally offer baking-related services such as private classes or workshops. All offerings are subject to availability and may change without notice.

4. Geographic Eligibility Our baked goods are available exclusively to customers located in New York State at the time of purchase and pickup or delivery. By placing an order, you confirm that you are physically present in New York and that the order will be fulfilled within the state, in compliance with applicable New York cottage food laws.

5. Allergen & Ingredient Disclaimer Our baked goods are made in a home kitchen that is not inspected by the Department of Health. While we take precautions, our kitchen regularly uses common allergens, including wheat, eggs, dairy, nuts, fish/shellfish, and soy.

As a result, our products are not suitable for individuals with moderate or severe food allergies, and we cannot guarantee that any item is free from allergens.

We offer select items made with gluten-free friendly ingredients; however, we are not a certified gluten-free facility, and these items are not safe for individuals with Celiac disease.

All information provided on this website, including ingredient details, product descriptions, recipes, baking tips, and any educational content, is intended for general informational purposes only. This information is not professional medical, nutritional, or legal advice.

We are not responsible for any adverse reactions, injuries, or damages resulting from the use or misuse of our products, including but not limited to allergic reactions.

Due to the handmade nature of our products and variations in ingredients, final products may differ slightly from photos or descriptions.

6. Returns, Refunds & Replacements Due to the perishable nature of our products, we do not accept returns. If you are unsatisfied with your order, please contact us within 24 hours of pickup or delivery. Replacements or refunds may be offered at our discretion.

7. Order Lead Time and Availability We kindly request at least one week’s notice for orders. More notice may be required for larger or more intricate orders.

While we occasionally accept last-minute requests, availability is not guaranteed and will depend on our current production schedule. Rush orders may be subject to an additional fee.

8. Order Customization & Changes Custom orders must be confirmed in writing and may be subject to additional charges. Changes to orders must be made at least 48 hours in advance and are not guaranteed once production has begun.

9. Pickup & Delivery Terms Pickup and delivery windows are scheduled in advance. If a customer misses their scheduled pickup or delivery time without notice, we may be unable to reschedule or issue a refund.

9A. Design Disclaimer We strive to honor customer design requests to the best of our ability. However, due to the handmade nature of our products and natural variation in ingredients, we cannot guarantee exact replication of designs, colors, or decorations—even those featured on our own website or social media. Each item is unique, and slight differences may occur.

10. Cancellations by Seller Willow Cottage Bakery reserves the right to cancel an order due to unforeseen circumstances, including but not limited to illness, personal emergencies, or supply issues. In the rare event that we must cancel your order, we will notify you as soon as possible and issue a full refund or offer to reschedule if applicable.

11. Force Majeure Willow Cottage Bakery is not liable for delays or cancellations caused by events beyond our control, including inclement weather, natural disasters, or supply chain disruptions.

12. Payments We accept payments via Visa, Mastercard, American Express, Discover, PayPal, Wave invoice (credit/debit card), Venmo, and Zelle. Full payment must be received before order fulfillment unless otherwise agreed.

13. Photography & Marketing Use We reserve the right to photograph our baked goods for promotional use, including on our website and social media platforms. General details such as occasion type (e.g., baby shower, birthday), types of items, and/or order size (e.g., two dozen cookies) may be shared, but we will never disclose full names, addresses, or personally identifying information without permission.

14. Intellectual Property All content on this site, including text, images, logos, recipes, and designs, is the intellectual property of Willow Cottage Bakery LLC and may not be used or reproduced without our written permission.

15. Dispute Resolution We prefer to resolve any disputes through informal negotiations. If a resolution cannot be reached, disputes will be settled through binding arbitration in New York State. Parties agree to mediate for at least 30 days before initiating arbitration. Each party will be responsible for its own arbitration-related fees and costs, and we will only be responsible for our own.

16. Limitation of Liability Our maximum liability for any claim relating to a purchase is limited to the lesser of the amount paid for the product or $250. We are not liable for indirect, incidental, or consequential damages.

17. Time Limit on Claims Customers must bring any claim within one (1) year of the date of the event giving rise to the claim.

18. Changes to These Terms We may update these Terms from time to time. The most current version will always be posted on our website.
